Last week, Shanghai Fengxian Customs penalized COSMAX (China) Cosmetics — the world’s largest cosmetics ODM and a supplier to Estée Lauder and L’Oréal. Between Aug 2022 and Jan 2024, COSMAX imported cosmetic raw materials including caprylic/capric triglyceride, declaring them under HS 3402.42.0000 (organic surface-active agents — no inspection category). The materials actually fall within China’s Statutory Inspection Directory (inspection categories R/S or M/N). Goods valued at ~RMB 1.435M had already been used in production. Fine: RMB 100,500.
Three takeaways:
- HS code drives inspection requirements, not just tariffs. A “clean” code skips inspection — until customs audits.
- Retroactive exposure is real. Consumed goods don’t erase the violation.
- Brand reputation travels. When your supplier gets flagged, your supply chain gets flagged.
Pre-classification review should cover both tariff rate AND inspection category. That’s where a broker with deep HS expertise earns their fee.
