The 10-digit statistical suffix? That’s where your Section 301 exclusion can quietly die.
On July 1, USITC revised certain 10-digit HTSUS reporting categories. Two months later — September 2 — USTR published conforming amendments to four China Section 301 exclusions in the Federal Register, racing to align exclusion coverage with the new numbers.
Affected products: pump parts (HTS 8413.91) and other plastic articles (HTS 3926.90). New suffixes include .9039, .9046, and .9059 for pumps, and .9915/.9920 replacing the old .9910 for plastics.
The risk: if your entry still carries the old suffix, ACE may not link it to the exclusion — and your qualified product could silently start accruing the 25% or 7.5% Section 301 duty the exclusion was designed to waive.
CBP hasn’t issued implementation instructions yet. Every entry filed since July 1 with old numbers is a potential audit flag.
