For importers facing complex pricing structures, transfer pricing arrangements, royalties, assists, or related-party transactions, determining the correct customs value can be a major compliance challenge.
China Customs offers an Advance Ruling on Customs Valuation, allowing enterprises to obtain an official determination of customs valuation treatment before goods are imported. This helps improve declaration accuracy, enhance transparency, and significantly reduce customs compliance risks.
Key Application Requirements:
Submit the application to the Customs authority directly supervising the applicant’s registration location.
The application should be filed at least 3 months before the intended import or export of the goods.
Required documents include:
• Advance Ruling Application Form
• Supporting contracts and transaction documents
• Relevant pricing and valuation materials
Processing Timeline:
Within 10 days of receiving the application, Customs will decide whether to accept the case and issue either:
• Acceptance Decision, or
• Non-Acceptance Decision
Within 60 days after acceptance, Customs will complete the review and issue an Advance Ruling Decision.
Validity Period:
The Advance Ruling Decision remains valid for 3 years.
During the validity period, if the imported or exported goods and transaction circumstances remain consistent with those described in the ruling, enterprises should declare according to the ruling, and Customs will recognize the declared valuation accordingly.
